DAVANI HOME TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of www.davanihome.com and the purchase of products and services from Davani Home LLC (“Davani Home,” “we,” “us,” or “our”).

By accessing our website, creating an account, submitting an order, accepting a quotation, or purchasing a product, you acknowledge that you have read, understood, and agreed to these Terms and all policies incorporated by reference.

 

1. Use of Our Services

You may use our website and services only for lawful purposes and in accordance with these Terms.

You must not:

●      Use the website in a manner that violates any applicable law or regulation;

●      Interfere with the security, availability, or operation of the website;

●      Attempt to gain unauthorized access to our systems or accounts;

●      Submit false, misleading, or fraudulent information;

●      Reproduce, distribute, or commercially exploit website content without authorization; 

●      Use automated tools to scrape, extract, or collect website content without our written permission.

We may suspend or restrict access when we reasonably believe these Terms have been violated.

 

2. Eligibility and Authority

By using our services or placing an order, you represent that:

●      You are at least 18 years old or have reached the age of majority in your jurisdiction;

●      You have the legal capacity to enter into a binding agreement;

●      If purchasing on behalf of a company, client, or another person, you have the authority to bind that party to these Terms.

You are responsible for providing accurate and complete billing, delivery, and contact information.

 

3. Product Information

Davani Home makes reasonable efforts to present accurate product descriptions, dimensions, materials, finishes, photographs, renderings, pricing, and availability. However, website content is provided for general reference and may contain minor errors or omissions.

Photographs, digital renderings, material samples, and screen displays may not reproduce the precise color, texture, scale, reflectivity, or finish of the final product. Appearance may vary due to lighting, photography, screen settings, material availability, and production methods.

We may make minor changes to product specifications when required for technical, structural, manufacturing, safety, or material reasons, provided those changes do not materially alter the product’s intended design, quality, or function.

If a material change is required, Davani Home will contact the client for review before proceeding where reasonably practicable.

 

4. Natural Stone and Handcrafted Variations

Davani Home products are individually crafted and may incorporate marble, natural stone, wood, metal, glass, and other materials with naturally occurring variations.

 

4.1 Unique Character of Marble and Natural Stone

Every marble and natural-stone product is unique. Variations may include:

●      Color and tonal movement;

●      Veining, grain, and pattern;

●      Mineral deposits and markings;

●      Pores, pits, fissures, and surface movement;

●      Texture, reflectivity, and finish;

●      Natural inclusions and geological characteristics;

●      Minor dimensional or artisanal variations within accepted manufacturing tolerances.

Davani Home and its suppliers will make reasonable efforts to select materials that are aesthetically harmonious and appropriately consistent within the individual product or product set. However, an exact match between separate slabs, production batches, samples, photographs, renderings, previously manufactured pieces, or products ordered at different times cannot be guaranteed.

These inherent characteristics are not defects and do not constitute grounds for rejection, cancellation, return, exchange, or warranty claims.

 

4.2 Client Acknowledgment at Purchase

By accepting these Terms and placing an order for a marble, stone, wood, metal, glass, or handcrafted product, the client expressly acknowledges and accepts that:

●      The delivered product will not be identical to website photographs, renderings, samples, or previously produced pieces;

●      Material consistency means a considered aesthetic selection—not identical veining, color, or pattern;

●      Book-matching, vein-matching, sequential slab selection, or approval of specific slabs is not included unless expressly stated in the written quotation or order confirmation;

●      Natural and handcrafted variations form part of the product’s individual character and value.

Where Davani Home provides slab or material photographs for approval, those images may be affected by lighting and screen conditions and do not guarantee exact color reproduction.

 

5. Pricing, Taxes, Duties, and Fees

Unless otherwise stated, prices are displayed in U.S. dollars.

Product prices may exclude shipping, freight, white-glove delivery, insurance, customs duties, import taxes, sales taxes, storage, inspection, installation, and other destination-related charges.

Applicable shipping charges, taxes, duties, or other known charges will be identified in the shipping quotation or during checkout before payment, where calculation is reasonably available. International clients remain responsible for governmental duties, taxes, customs assessments, brokerage charges, and destination fees unless the written quotation expressly states that they are included.

We may correct pricing, description, calculation, or typographical errors before accepting an order. If an error is discovered after payment, we will notify the client and provide the available lawful options, which may include confirming the corrected order or cancelling the affected item for a refund.

 

6. Orders and Acceptance

Submitting an order does not automatically constitute acceptance by Davani Home.

An order is accepted only after Davani Home:

●      Confirms product and material availability;

●      Reviews the delivery destination and applicable restrictions;

●      Successfully receives or authorizes payment;

●      Issues an order confirmation or otherwise confirms acceptance in writing.

We may decline or cancel an order for legitimate reasons, including product unavailability, pricing errors, suspected fraud, payment failure, export restrictions, delivery limitations, or an inability to fulfill the order safely or lawfully.

If Davani Home cancels an order before production or shipment, amounts paid for the cancelled item will be refunded, subject to applicable law.

 

7. Payment

Unless otherwise agreed in writing, payment is due in full when the order is placed.

The client represents that they are authorized to use the selected payment method. The client is responsible for any bank charges, foreign-exchange fees, wire fees, or payment-provider charges associated with the transaction.

Davani Home is not required to begin material procurement, engineering, shop drawings, fabrication, or production until cleared payment and all required client approvals have been received.

 

8. Made-to-Order Products

Davani Home products are made to order according to the standard designs, dimensions, materials, finishes, and specifications displayed on the product page at the time of purchase.

Because products are made to order, production begins after the order and payment have been confirmed. Clients are responsible for reviewing all product details, dimensions, materials, finishes, lead times, delivery requirements, and applicable policies before placing an order.

Natural materials may exhibit variations in color, veining, texture, pattern, and surface character. Such variations are inherent to the material and do not constitute customization, damage, or a manufacturing defect.

 

9. Estimated Lead Times and Delays

Production, shipment, and delivery dates are estimates unless expressly guaranteed in writing. Delays may arise from artisanal production, material availability, quality-control requirements, customs processing, carrier disruption, severe weather, port congestion, governmental action, or other circumstances outside Davani Home’s reasonable control.

If Davani Home cannot ship within the stated period, we will provide notice and any options required by applicable law.

  

10. Shipping, Delivery, and Inspection

Products are generally shipped from Italy. Shipping methods, delivery scope, estimated transit times, and applicable charges will be confirmed at checkout, through a separate quotation, or in the order confirmation.

Clients are responsible for ensuring that the delivery location is accessible, properly prepared, and suitable for receiving the order. Unless white-glove delivery is expressly purchased, freight delivery may be curbside only.

All shipments must be inspected upon arrival. Visible damage or shortages must be documented before signing the delivery receipt, while concealed damage, defects, missing components, or incorrect merchandise must be reported to info@davanihome.com within three business days, with supporting photographs and delivery documentation. All packaging must be retained, and products must not be installed, altered, used, or returned until written instructions are provided.

If delivery cannot proceed because the client is not ready to receive the order, storage may be arranged subject to availability, written confirmation, and any applicable charges.

11. Returns and Refunds

Returns are governed by the Davani Home Return & Refund Policy, which is incorporated into these Terms.

Eligible in-stock products require prior written return authorization and may be subject to a 25% restocking fee. Original shipping charges, return freight, duties, taxes, insurance, handling, and third-party service costs are generally non-refundable.

Made-to-order, clearance, and final-sale merchandise is not eligible for return except where required by applicable law or where Davani Home confirms a covered defect.

 

12. Limited Warranty

Eligible products are covered by the Davani Home Limited Warranty Policy, which is incorporated into these Terms.

Unless otherwise stated, Davani Home provides a one-year limited warranty from the date of delivery against verified defects in materials and craftsmanship under normal residential use. Integrated LED fixtures are covered by the separate warranty period stated in the Limited Warranty Policy.

For an approved claim, Davani Home will determine the appropriate remedy, which may include repair, replacement components, product replacement, merchandise credit, or refund, subject to applicable law.

 

13. Installation and Third-Party Services

Davani Home does not provide installation, assembly, site preparation, electrical work, plumbing, engineering, inspection, storage, or local permitting.

The client is responsible for retaining qualified professionals and confirming that the product is suitable for the intended site and use.

Davani Home is not responsible for charges or losses arising from third parties independently retained by the client, including installers, contractors, designers, inspectors, freight receivers, storage facilities, packaging companies, electricians, plumbers, or delivery providers.

Clients should not schedule installation labor until the product has been delivered, inspected, and confirmed to be complete and undamaged.

 

14. Intellectual Property

All website content—including product designs, photographs, renderings, drawings, text, videos, graphics, logos, trademarks, collections, and website architecture—is owned by or licensed to Davani Home and is protected by applicable intellectual-property laws.

No content may be copied, reproduced, modified, distributed, published, displayed, reverse-engineered, manufactured, or commercially used without prior written authorization.

Purchase of a product does not transfer any intellectual-property, reproduction, manufacturing, or commercial-use rights.

 

15. Privacy

Use of our website and services is governed by the Davani Home Privacy Policy, which explains how personal information is collected, used, stored, and disclosed.

By using the website, you acknowledge the practices described in that policy.

 

16. Third-Party Services and Links

Our website may use or link to third-party platforms, payment processors, carriers, applications, or websites.

Davani Home is not responsible for the independent content, availability, security, privacy practices, or performance of third-party services. Use of those services may be subject to separate terms imposed by the applicable provider.

 

17. Disclaimer of Warranties

Except for the express Limited Warranty and any rights that cannot lawfully be excluded, our website and services are provided on an “as available” basis.

To the fullest extent permitted by law, Davani Home disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits a warranty or consumer right that cannot legally be waived.

 

18. Limitation of Liability

To the fullest extent permitted by law, Davani Home will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profit, use, business opportunity, data, or goodwill.

Davani Home is not responsible for losses arising from:

●      Improper installation, handling, storage, or maintenance;

●      Failure to confirm access or site conditions;

●      Third-party services or conduct;

●      Natural material characteristics;

●      Unauthorized product alterations;

●      Client-provided specifications or measurements;

●      Events outside Davani Home’s reasonable control.

Except where prohibited by law, Davani Home’s total liability relating to a product will not exceed the amount actually paid to Davani Home for the product giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be excluded or limited.

 

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Davani Home and its affiliates, officers, employees, and representatives from third-party claims, liabilities, damages, and reasonable legal expenses arising from:

●      Your unlawful use of the website or services;

●      Your material breach of these Terms;

●      Inaccurate specifications or information supplied by you;

●      Unauthorized alteration, installation, resale, or commercial use of a product;

●      Your violation of another person’s rights.

This provision does not require a consumer to indemnify Davani Home for Davani Home’s own unlawful conduct, negligence, or breach.

 

20. Events Beyond Reasonable Control

Davani Home is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, war, civil unrest, labor disruption, epidemics, governmental action, sanctions, material shortages, utility failures, customs delays, port closures, transportation disruption, or carrier failure.

Davani Home will make reasonable efforts to communicate material delays and manage affected orders in accordance with applicable law.

 

21. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Subject to any mandatory consumer protections or jurisdictional rights that cannot be waived, disputes arising from these Terms or a purchase from Davani Home will be brought in the state or federal courts serving Clark County, Washington.

For clients outside the United States, nothing in this section removes mandatory consumer rights provided by the laws of the client’s jurisdiction where those rights legally apply.

 

22. Changes to These Terms

We may update these Terms periodically. Revised Terms will be posted on this page with an updated effective date.

Changes will apply prospectively and will not materially alter the terms of an already accepted order unless:

●      The client agrees in writing;

●      The change is required by law;

●      The change does not materially reduce the client’s contractual rights.

 

23. Severability and No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Failure by Davani Home to enforce a provision does not waive its right to enforce that provision later.

 

24. Entire Agreement and Policy Priority

These Terms, together with the applicable order confirmation, quotation, invoice, product specifications, Shipping Policy, Return & Refund Policy, Limited Warranty Policy, and Privacy Policy, constitute the agreement between the client and Davani Home regarding the purchase.

If documents conflict, the following order of priority applies unless otherwise agreed in writing:

1. A signed custom agreement or approved written quotation;
2. The order confirmation;
3. Product-specific terms disclosed before purchase;
4. These Terms of Service;
5. General website policies.
